Damage without a third party in Spain: who pays in the event of parking damage or a single-vehicle accident?

What if there is no one to blame?

You return to the supermarket parking lot and see a dent in your car. No note under the windshield wiper. No witnesses. Or you are driving on a rural road at night and hit an animal crossing the road. There, too, there is no opposing party that can be held liable.

Many Dutch-speakers in Spain then assume that “the opposing party's insurance” will intervene. But what if that opposing party is not there, or remains unknown?

In this in-depth article, we examine how damage without a third party in Spain is handled from a legal and insurance perspective, and where the differences lie with Belgium and the Netherlands.

The reimbursement of damage without a third party in Spain depends mainly on your own car insurance. With only the mandatory liability coverage, your own car damage is normally not reimbursed. A comprehensive coverage that can be done, possibly after deduction of the agreed upon franchise. The policy conditions always remain decisive.

Not every situation without a known counterpart is handled in the same way. The decision tree below shows which party may be involved in the event of damage without a counterpart in Spain.

What does “damage without a counterparty” mean?

Damage without a third party means that:

  • No other driver or liable third party can be identified.
  • The damage was not caused by a clearly identifiable external party.
  • There is no jointly completed claim form (friendly match) is.

Typical situations in Spain are:

  • Hit-and-run parking damage.
  • Vandalism.
  • Damage by an unknown vehicle.
  • Collision with a wild animal.
  • A single-vehicle accident (you lose control of the vehicle).
  • A recent pothole in the road.
  • A piece of falling rock on a mountain road.

In all these cases, you cannot, or cannot simply, file a classic liability claim against a third party. In the case of a pothole, falling rocks, or certain wildlife accidents, there may sometimes be another responsible party. That depends on the circumstances and the available evidence.

How does this work in the Spanish insurance system?

In Spain civil liability (Civil liability) mandatory. This coverage reimburses damage that you cause to third parties.

If no liable third party can be identified or proven, the primary focus will be on your own policy and the type of coverage you have taken out. In exceptional situations, the Consorcio, a road manager, or another responsible party may also come into consideration.

1. Third-party liability insurance only

Do you only have the mandatory third-party liability coverage?

Then your own damage will not be reimbursed.

The insurance only covers damage you cause to others. Damage to your own vehicle remains entirely at your own expense.

This is an important difference from what some expats expect, especially if they are used to additional guarantees in their home country.

2. Partial coverage

A more comprehensive third-party liability policy often includes the following coverages:

  • Theft.
  • Brand.
  • Glass breakage.
  • Sometimes nature damage or specific coverage for a collision with animals.

But

With only third-party liability (BA) or limited casco coverage, remaining damage without a third party in Spain usually at your own expense, unless the specific cause is explicitly covered in the policy. Damage by an unknown driver or a single-vehicle accident is generally not covered under standard coverage.

This often causes confusion. An “extended third-party liability insurance” sounds broader than it actually is.

3. Omnium

With a comprehensive insurance (comprehensive coverage) is damage to your own vehicle generally covered, even when:

  • There is no opposing party.
  • You made a mistake yourself.
  • The opposing party remains unknown.

A comprehensive coverage can with or without franchise are concluded. For a policy with franchise you pay the agreed amount yourself. Read more about comprehensive coverage and deductible.

What to do in a hit-and-run?

When someone damages your vehicle and drives away, people in Belgium and the Netherlands often speak of the Joint Motor Vehicle Guarantee Fund.

In Spain, a similar fund exists: the Insurance Compensation Consortium.

However, this fund only intervenes in specific cases, such as:

  • Uninsured vehicles.
  • Unknown vehicles in personal injury.
  • Certain extraordinary risks.

Important difference:

In the case of purely material damage without a third party in Spain the Consorcio usually does not intervene. In the case of an unknown vehicle, material damage can only be compensated under limited legal conditions, for example when the same accident also caused significant personal injury. A regular dent in a parking lot without injuries is normally not covered.

That means a dent in a parking lot without witnesses is in practice usually only insured through your own comprehensive insurance or another explicitly included own-damage coverage. The current conditions are in the Spanish Motor Insurance Act.

Collision with an animal: a typically Spanish risk

In rural regions of Spain, collisions with wild animals, especially wild boars, are common.

The coverage varies per policy:

  • With third-party liability only: typically no coverage for damage to your own vehicle.
  • With limited casco: only when a specific guarantee for a collision with animals is included.
  • Comprehensive coverage: usually covered, possibly with franchise.

Liability also depends on the circumstances. The DGT describes, among other things, exceptions related to a recent collective hunt or a lack of fencing or signage.
